Pursuant to Article L 111-1 of the Consumer Code, each product is subject to a decription allowing the potential consumer to know before ordering the essential characteristics of the product they wish to buy.
The offers presented are valid only within the limits of available stocks
Photographs and illustrations of the products presented on the site are not contractual, liability of the publisher of this site can not be held if the characteristics of the products are different from their visuals on the website or if they are uncorrect or uncomplete
SECTION 3: CONTROL AND ELECTRONIC SIGNATURE
Any order of an item presented in the "C & M Racing Shop" online store from the website cmracing.eu, requires the consultation and unconditional acceptance by the user/customer, completeness of these General Conditions.
This acceptance takes the form of a check box by the user. This action to check the box "I read and I accept all the terms and genera conditions of the site" will be deemed to have the same value as a handwritten signature and will constitute an acceptation, irrevocable and unconditional of the terms and conditions of the site and of the order by the customer. It belongs to this latter to print or to save them.
It is reminded that the acceptance of these conditions involves buyers to have of legal capacity to do so, or obtain the permission from their legal representative in the case of minor or guardian / trustee in the case of an inability.
SECTION 4: ACCOUNT AND ORDER
All orders require the prior creation of a customer account. To do this, the user will be asked to provide certain personal data. The user / consumer is committed to providing accurate information. This account will allow the customers to check their orders at the site and to track the deliveries.
The publisher cannot be held responsible for the disappearance of the data contained under "customer account" as a result of a fortuitous event, a technical failure or force majeure.

SECTION 6 - PAYMENT
To pay the order, the consumer can make payment by credit card. These credit card payments are done through secure transactions provided by the service PAYBOX using a SSL (Secure Socket Layer).
The company C & M RACING EUROPE reserves the right to suspend any order and any delivery in case of refusal to authorize payment by credit card by certified financial institutions or in case of non-payment.
The company C & M RACING EUROPE reserves the right to refuse a delivery or an order from a customer who has not fully paid or partly a previous order or with whom a dispute is currently being administration.
SECTION 7 - PRODUCT AVAILABILITY
Orders for items marked "in stock" in their description will be delivered in colissimo by post within seven days (for French market only, it can be longer for other markets) of full payment of the order.
However, in case of unavailability of the ordered product (especially due to our suppliers), the time is mentioned in the product description.
In this case, the customer will have the option to cancel the order (with refund of amounts paid as long as the order is not shipped), or to accept delivery times provided by the company C & M RACING EUROPE. In the case of a cancellation request, it must be made by sending an email to the address info@cmracing.eu.
SECTION 8 - NON HOMOLOGATED PRODUCTS
If some parts listed on this site are not certified for road use, it will be expressly stated in bold letters in the description of prduit, and in the summary of the order (cart).
Moreover, in this case, the order will be confirmed only by checking the box "I acknowledge that one or more items included in my cart are not approved for road use and are intended to be used on private road (track, competition, ...) ".
At the same, the responsibility of C & M RACING EUROPE can not be engaged in case of use by the Customer of non homologated equipment for road use. Customer acknowledges having been informed and aware of their non-approved products concerned.
It is recalled that the use of non homologated product may change the characteristics of the vehicle is prohibited on public roads.
SECTION 9 - ORDER DELIVERY
Delays are estimated in business days and run from the order confirmation by the company C & M RACING EUROPE, formalized by sending a mail to the customer informing him of the status of his order being processed.
Deliveries are made to the address listed in the order that can only be in the area agreed.
The goods are delivered at the risk of the purchaser at the time the goods leave the warehouse of C & M RACING EUROPE.
CAUTION: If your package is delivered damaged or obviously in poor condition, refuse it! Do not sign the delivery without reservation.
The customer has to check the parcel upon the delivery. He must report any damage to the carrier on the delivery note and to the company C & M RACING EUROPE, within 48 hours. Any anomaly concerning the delivery (damage, torn or damaged package, missing or broken product ...) should imperatively be mentioned on the delivery form of "handwritten reserves", accompanied by the signature of the buyer. Meanwhile, he will confirm his reserves to the carrier, in this case the post office by registered mail with return recepton within 72 hours of delivery date.
In case the buyer would have accepted the parcel, it must make a reasoned protest against the carrier / Post as soon as possible.
SECTION 10 - PORBLEMS ON ORDER DELIVERY.
In case of non-receipt a parcel within the period announced, a request for information will be made to the Post services. This implies a period during which no refund or any new shipment will not be done.
In case of mistake in a delivery or in an exchange, any product to exchange or refund will be returned to C & M Racing Europe as a whole and in its original packaging, in Colissimo, at the following address: C & M RACING EUROPE, rue de la recherche n°1, 7503 FROYENNES BELGIUM. However, to be accepted, any return will be reported, in advance by email to info@cmracing.eu
In the absence of receipt of the product by the buyer at the end of the delivery / removal because of absence or non retrait, the company C & M RACING EUROPE reserves the right to recover the goods. After contact with the consumer, by phone or email, the order will be in agreement of the parties, canceled and the company C & M RACING EUROPE will then refund the product price within 30 days from the date of receipt the product in return, net of transport costs being borne by the consumer, or shipped back to the shipping address with new transportation costs charged to the buyer
SECTION 11 - GARANTIES
All products supplied by C & M RACING EUROPE benefit from the legal guarantee provided for in Articles 1641 et seq.
In case of non-compliance of a product sold, it can be returned to the vendor who will exchange or refund only if the product is in its state (packaging, labels, etc ...) of origin.
All complaints, requests for exchange or refund must be made by mail or by post info@cmracing.eu at the following address: CM RACING EUROPE - Rue de la Recherche, 1 - B-7503 FROYENNES (Belgium ) within thirty days of delivery.
To obtain warranty service, it is essential that the relevant accessories are mounted by a professional with the skills and tools needed.
The warranty is applicable on presentation of invoice. The warranty is limited to a simple exchange of the part without any further compensation can be claimed.
Cases where the guarantee is excluded:
The garantie is not accepted for defects and damages caused by normal wear and tear, by an accident, in case of competition use, inappropriate use, incorrect installation, modification of equipment or parts, faulty maintenance, or if storage is not appropriate, and supplies ... (this list is not exhaustive). The garantie does not apply in case of intervention, dismunting by the buyer or a non skilled worker.
SECTION 12 - RIGHT OF WITHDRAWAL
To ensure faster processing in case of withdrawal (statutory period of seven days), we invite our customers to notify in advance by e-mail (info@cmracing.eu) or by phone at +32 69 25 30 30. It is imperative to declare the return request within 7 calendar days or return the product within 7 days in the absence of declaration. This period starts from the date of receipt of the order.
We ask to the consumer to return the products as a whole, in the original packaging complete, intact and in perfect condition for resale.
All product received uncomplete will be returned to sender and will not be refunded or exchanged. Clothes have not to be wear.
This right of withdrawal is without penalty, except the freight costs for return
SECTION 13 - PROOF OF THE TRANSACTION
C & M RACING EUROPE purchase orders and invoices are archived on a reliable and durable support as a true copy in accordance with the provisions of section 1348 of the Civil Code.
The records of C & M RACING EUROPE. will be considered by the parties as proof of communications, orders, payments and other transactions between the parties
SECTION 14 - DISCLAIMER
Unable to access the site due to technical problems or any other cause, the customer can not claim any compensation .
The unavailability, even for a long period without any limitation, of one or more products can not be constitutive of injury to users and can in no way lead to the award of compensation by the site editor
Neither party will have failed in its contractual obligations, to the extent that their execution is delayed or prevented by a fortuitous event or force majeure.
